{"id":4366,"date":"2018-08-31T11:52:10","date_gmt":"2018-08-31T09:52:10","guid":{"rendered":"https:\/\/igifoodlaw.com\/?p=4366"},"modified":"2026-02-10T11:53:25","modified_gmt":"2026-02-10T10:53:25","slug":"botanical-ingredients-in-foods-including-food-supplements-new-rules","status":"publish","type":"post","link":"https:\/\/igifoodlaw.com\/en\/botanical-ingredients-in-foods-including-food-supplements-new-rules\/","title":{"rendered":"Botanical Ingredients in Foods (Including Food Supplements) \u2013 New Rules"},"content":{"rendered":"<p data-start=\"0\" data-end=\"299\">Pursuant to <strong data-start=\"12\" data-end=\"58\">Article 11 of Regulation (EC) No 1925\/2006<\/strong> on the addition of vitamins and minerals and of certain other substances to foods, Member States may adopt national measures introducing <strong data-start=\"196\" data-end=\"228\">prohibitions or restrictions<\/strong> on the use of certain substances in the manufacture of specific foods.<\/p>\n<p data-start=\"301\" data-end=\"527\"><strong data-start=\"301\" data-end=\"311\">Latvia<\/strong> has now used this option and\u00a0<strong data-start=\"421\" data-end=\"526\"><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">notified the\u00a0<strong>European Commission<\/strong>\u00a0and the other Member States of a draft\u00a0<strong>Regulation on plants, plant parts, and other substances whose use in food<\/strong><\/span>\u00a0is prohibited or restricted<\/strong>.<\/p>\n<p data-start=\"529\" data-end=\"562\">The draft regulation establishes:<\/p>\n<ul data-start=\"563\" data-end=\"959\">\n<li data-start=\"563\" data-end=\"667\">\n<p data-start=\"565\" data-end=\"667\">a <strong data-start=\"567\" data-end=\"619\">list of plants, plant parts and other substances<\/strong> whose use in foods is prohibited or restricted,<\/p>\n<\/li>\n<li data-start=\"668\" data-end=\"858\">\n<p data-start=\"670\" data-end=\"858\">a <strong data-start=\"672\" data-end=\"698\">notification procedure<\/strong> for the distribution of multi-ingredient foods containing plants or plant parts, including rules on <strong data-start=\"799\" data-end=\"853\">registration and cancellation of such registration<\/strong>, and<\/p>\n<\/li>\n<li data-start=\"859\" data-end=\"959\">\n<p data-start=\"861\" data-end=\"959\"><strong data-start=\"861\" data-end=\"898\">additional labelling requirements<\/strong> for multi-ingredient foods containing plants or plant parts.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"961\" data-end=\"1009\">The draft regulation includes <strong data-start=\"991\" data-end=\"1008\">three annexes<\/strong>:<\/p>\n<p data-start=\"1011\" data-end=\"1105\"><strong data-start=\"1011\" data-end=\"1085\">Annex 1 \u2013 List of plants and plant parts that may not be used in foods<\/strong> (62 entries), e.g.:<\/p>\n<ul data-start=\"1106\" data-end=\"1238\">\n<li data-start=\"1106\" data-end=\"1238\">\n<p data-start=\"1108\" data-end=\"1238\"><em data-start=\"1108\" data-end=\"1124\">Arnica montana<\/em> (mountain arnica) \u2013 whole plant \u2013 food supplements containing this ingredient are available on the Polish market.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1240\" data-end=\"1336\"><strong data-start=\"1240\" data-end=\"1316\">Annex 2 \u2013 List of plants or plant parts whose use in foods is restricted<\/strong> (16 entries), e.g.:<\/p>\n<ul data-start=\"1337\" data-end=\"1542\">\n<li data-start=\"1337\" data-end=\"1542\">\n<p data-start=\"1339\" data-end=\"1542\"><em data-start=\"1339\" data-end=\"1354\">Urtica dioica<\/em> L. (stinging nettle) \u2013 the root may be used <strong data-start=\"1399\" data-end=\"1427\">only in food supplements<\/strong> (in Poland, products in categories other than supplements are available, e.g. herbal teas containing nettle root).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1544\" data-end=\"1629\"><strong data-start=\"1544\" data-end=\"1622\">Annex 3 \u2013 Maximum levels of selected active substances in food supplements<\/strong>, e.g.:<\/p>\n<ul data-start=\"1630\" data-end=\"1705\">\n<li data-start=\"1630\" data-end=\"1668\">\n<p data-start=\"1632\" data-end=\"1668\"><strong data-start=\"1632\" data-end=\"1646\">Hesperidin<\/strong> \u2013 less than <strong data-start=\"1659\" data-end=\"1668\">50 mg<\/strong><\/p>\n<\/li>\n<li data-start=\"1669\" data-end=\"1705\">\n<p data-start=\"1671\" data-end=\"1705\"><strong data-start=\"1671\" data-end=\"1684\">Melatonin<\/strong> \u2013 less than <strong data-start=\"1697\" data-end=\"1705\">2 mg<\/strong><\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1707\" data-end=\"1766\">The planned entry into force date is <strong data-start=\"1747\" data-end=\"1765\">1 January 2020<\/strong>.<\/p>\n<p data-start=\"1768\" data-end=\"2110\">Latvia is another EU Member State to introduce national rules on the use of botanical ingredients in food. <strong data-start=\"1875\" data-end=\"1915\">Poland has no equivalent regulation.<\/strong> As a result, when assessing whether a botanical ingredient can be used in a food (including a food supplement), it is necessary to rely on a range of documents\u2014both <strong data-start=\"2081\" data-end=\"2090\">legal<\/strong> and <strong data-start=\"2095\" data-end=\"2109\">scientific<\/strong>.<\/p>\n<p data-start=\"2112\" data-end=\"2134\">Key questions include:<\/p>\n<ul data-start=\"2135\" data-end=\"2401\">\n<li data-start=\"2135\" data-end=\"2207\">\n<p data-start=\"2137\" data-end=\"2207\">How to verify whether a botanical ingredient may be used in a product?<\/p>\n<\/li>\n<li data-start=\"2208\" data-end=\"2295\">\n<p data-start=\"2210\" data-end=\"2295\">What is the relationship between rules on ingredients and <strong data-start=\"2268\" data-end=\"2282\">Novel Food<\/strong> legislation?<\/p>\n<\/li>\n<li data-start=\"2296\" data-end=\"2401\">\n<p data-start=\"2298\" data-end=\"2401\">What impact do regulations adopted in other Member States have on products placed on the Polish market?<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2403\" data-end=\"2558\">The use, labelling and advertising of botanical ingredients are frequent topics of advisory projects and practical workshops delivered by <strong data-start=\"2541\" data-end=\"2557\">IGI FOOD LAW<\/strong>.<\/p>\n<p data-start=\"2560\" data-end=\"2636\">Enquire about an advisory project or training: <strong data-start=\"2607\" data-end=\"2636\"><a class=\"decorated-link cursor-pointer\" href=\"mailto:igifoodlaw@igifoodlaw.com\" target=\"_blank\" rel=\"noopener\" data-start=\"2609\" data-end=\"2634\">igifoodlaw@igifoodlaw.com<\/a><\/strong><\/p>\n<p data-start=\"2638\" data-end=\"2676\" data-is-last-node=\"\" data-is-only-node=\"\"><strong data-start=\"2638\" data-end=\"2676\" data-is-last-node=\"\">IGI FOOD LAW | FOOD LAW | TRAINING<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pursuant to Article 11 of Regulation (EC) No 1925\/2006 on the addition of vitamins and minerals and of certain other substances to foods, Member States may adopt national measures introducing prohibitions or restrictions on the use of certain substances in the manufacture of specific foods.
