While inspiration is welcome, we kindly ask for ethical use of our materials and respect for IGI FOOD LAW\u2019s intellectual property rights and know-how.<\/em><\/p>\n<p data-start=\"571\" data-end=\"1206\">The case concerns an ingredient defined as <strong data-start=\"614\" data-end=\"702\">\u201cpowder from partially defatted seeds of <em data-start=\"657\" data-end=\"672\">Brassica rapa<\/em> L. and <em data-start=\"680\" data-end=\"696\">Brassica napus<\/em> L.\u201d<\/strong>, the specification of which has been amended, requiring an update to the Union list of authorised novel foods (via an amendment to Implementing Regulation (EU) 2017\/2470). The key issue does not relate to the safety of the product as such, but rather to whether the European Commission correctly concluded that the scientific assessment from the original authorisation[2] remains sufficient in light of the change in use, or whether a new opinion from the <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">European Food Safety Authority<\/span><\/span> was required.<\/p>\n<p data-start=\"1208\" data-end=\"1552\">EFSA had previously assessed a specific form of this ingredient. The Commission subsequently accepted a modified version without referring the matter back to EFSA. The complainant argues that the changes introduced (including technological modifications) may affect the safety profile and should therefore have been subject to a new assessment.<\/p>\n<p data-start=\"1554\" data-end=\"1630\">In this context, the European Ombudsman has asked the Commission to clarify:<\/p>\n<ul data-start=\"1632\" data-end=\"1932\">\n<li data-section-id=\"1t60t49\" data-start=\"1632\" data-end=\"1718\">why it considered that the previous EFSA opinion also covers the modified product,<\/li>\n<li data-section-id=\"133sn7r\" data-start=\"1719\" data-end=\"1785\">whether it holds internal analyses supporting this conclusion,<\/li>\n<li data-section-id=\"ngntg5\" data-start=\"1786\" data-end=\"1932\">and whether it properly informed the public about the scientific basis of its decision in accordance with <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Regulation (EU) 2015\/2283<\/span><\/span>.<\/li>\n<\/ul>\n<p data-start=\"1934\" data-end=\"2123\">The inquiry does not assess the safety of the product itself. Its purpose is to determine whether the Commission adequately substantiated its decision and acted transparently.<\/p>\n<h3 data-section-id=\"13kx4om\" data-start=\"2125\" data-end=\"2169\">Implications for food business operators<\/h3>\n<p data-start=\"2171\" data-end=\"2361\">The case illustrates a key regulatory risk in the novel food area: whether a modified product still falls within the scope of an existing EFSA assessment or requires a new procedure. If the Commission\u2019s approach is challenged, this may lead to a more stringent assessment of technological and specification changes, and consequently to longer and more complex authorisation procedures for new products.<\/p>\n<p data-start=\"2584\" data-end=\"2703\">The case is ongoing.
