It confirms that names reserved for milk and dairy products cannot be used for plant-based products, in line with Regulation (EU) No 1308\/2013 and the CJEU case law (Case C-422\/16 <em data-start=\"408\" data-end=\"418\">TofuTown<\/em>).<\/p>\n<p data-start=\"422\" data-end=\"563\">The prohibition covers not only the direct use of the term \u201cmilk\u201d, but also any forms suggesting a dairy character of the product, including:<\/p>\n<ul data-start=\"564\" data-end=\"712\">\n<li data-section-id=\"sdhfxb\" data-start=\"564\" data-end=\"601\">terms such as \u201cplant-based milk\u201d,<\/li>\n<li data-section-id=\"1k3eypg\" data-start=\"602\" data-end=\"653\">negating expressions (e.g. \u201cthis is not milk\u201d),<\/li>\n<li data-section-id=\"18frclg\" data-start=\"654\" data-end=\"712\">verbal or graphic elements referring to the term \u201cmilk\u201d.<\/li>\n<\/ul>\n<p data-start=\"714\" data-end=\"960\">GIJHARS emphasises that labelling, presentation and advertising must not mislead consumers as to the nature of the product.
