The proposal focuses primarily on strengthening the traceability of input materials, reinforcing documentation requirements, and enhancing controls on imports of recycled plastic materials from third countries.<\/p>\n<p>The proposed amendments are mainly practical and administrative in nature but are expected to have a significant impact on the entire supply chain for recycled plastic food contact materials.<\/p>\n<h3>Key proposed changes<\/h3>\n<p>The draft introduces several important amendments, including:<\/p>\n<ul>\n<li>new categories of Declarations of Compliance (DoCs):\n<ul>\n<li>Declaration D, to accompany each batch of plastic waste or pre-processed plastics supplied for a decontamination process, containing information on the origin of the material, collection method and other traceability data;<\/li>\n<li>Declaration C, for recycled plastic materials and articles whose composition does not undergo further modification at subsequent stages of manufacture;<\/li>\n<\/ul>\n<\/li>\n<li>a requirement to provide Declarations of Compliance and supporting compliance documentation throughout the supply chain, subject to limited exceptions at the retail level;<\/li>\n<li>an obligation to make compliance documentation available to competent authorities within three working days of a request;<\/li>\n<li>new documentation requirements for customs authorities when certain imported recycled plastic materials and articles\u2014particularly mechanically recycled PET\u2014are released for free circulation in the EU;<\/li>\n<li>the establishment of an electronic registration system for recycling installations, replacing the current notification-based system and allowing operators to manage their registrations directly.<\/li>\n<\/ul>\n<p>The proposal also introduces more detailed traceability requirements for recycled plastic input materials. Each batch will have to be accompanied by information identifying, among other things, the origin of the material (EU or third country), the collection system and batch numbers enabling full traceability throughout the supply chain. In addition, recyclers will be required to retain samples of every batch of input material for at least two years. A significant innovation concerns imported recycled plastics. The Commission proposes that specified categories of imported recycled plastic materials and articles should be accompanied by compliance documentation already at the customs clearance stage. The objective is to reduce the risk of non-compliant materials entering the EU market and to improve the traceability of imported recycled plastics. The proposal also introduces mandatory use of ISO 12418-2:2012 (or an equivalent method) for assessing the quality of PET flakes used as feedstock in decontamination processes, thereby harmonising quality control requirements for recycled materials.<\/p>\n<h3>Significance for businesses<\/h3>\n<p>The proposed amendments will be particularly relevant for manufacturers of food contact materials, plastic recyclers, PET packaging producers, importers and exporters of products containing recycled plastics.<\/p>\n<p>If adopted in its current form, companies will need to review and update their documentation management systems, traceability procedures, and customs compliance processes. The new obligations relating to Declarations of Compliance and the collection and retention of supporting documentation throughout the supply chain are expected to require significant compliance efforts.<\/p>\n<p>According to the current legislative timetable, the Regulation is expected to be adopted by 30 September 2026.
